SymbolStory - Terms of Use

Symbol Story Ltd., together with its subsidiaries ("SymbolStory," "we," "our," or "the company"), invites you ("yourself," "you," or "the user") to use our support and community promotion platform with our unique needs ("SymbolStory Platform") through the use of the SymbolStory mobile/browser/desktop application ("the Application") and to visit our website at https://www.symbolstory.app/ ("the Website") (SymbolStory Platform, the Application, the Website, and additional services that SymbolStory may offer from time to time, collectively referred to as "the Services," "the Service," or "SymbolStory Services") (all as defined in more detail in these terms of use). The permission to use SymbolStory Services is granted to you only in accordance with the terms and conditions of these terms of use. Reference in the feminine gender includes both genders.

Consent to Terms

By entering, logging in, or accessing the services, or using them, and/or by creating an account on your own, you affirm that you have read and understood the terms of use herein, including those of our privacy policy, available at: https://SymbolStory.health/privacy-policy ("Privacy Policy," together with the Terms of Use, "the Terms"), and you agree to be bound by them and comply with the requirements of all laws and regulations regarding the use of the services. You further affirm that these terms of use constitute a binding and enforceable contract between SymbolStory and yourself.

If you do not agree to these terms of use, please do not enter, log in, or access the services or any part thereof, or use them or any part thereof, in any way

2. The service

SymbolStory Services provide a digital platform based on artificial intelligence that creates a training/practice program based on social stories taking place in the home and educational environment ("Practice"). This platform is tailored for children ("Recipients") and provides parents, communication clinicians, behavior analysts, and educators with tools to monitor the performance of practices while maintaining the continuity of care. Additionally, it allows the sharing of information among the parents of the Recipients ("Parent" or "Parents," "Parent" in this policy, including legal guardians) with communication clinicians or behavior analysts registered with SymbolStory Services ("Clinicians"), all after obtaining parental consent to share the medical information of the Recipient with a specific clinician registered with SymbolStory Services ("Treating Clinician").

The services are available to parents (and therefore, Recipients) independently, allowing them to invite the Treating Clinician to the SymbolStory platform and thereby confirm the sharing of the Recipient's private information with the Treating Clinician. Alternatively, after the Treating Clinician opens a Recipient file for the parents on the SymbolStory platform, the use of an application allows the Treating Clinician to present the required practices to the parents and allows parents to record and transmit the Recipient's exercises and practices to the Treating Clinician. Additionally, the services enable Treating Clinicians to document and manage the provision of treatment services to the Recipient, including through the application, and to improve and customize these services optimally for the Recipient.

All output, including but not limited to stories, text, and other materials, generated by SymbolStory's AI-based engine ("Generated Output") is the sole and exclusive property of SymbolStory. SymbolStory retains all copyrights and other intellectual property rights to the Generated Output, and users agree that SymbolStory has the unrestricted right to reuse, repurpose, or modify the Generated Output for any purpose, including future development, marketing, or other uses.

By using SymbolStory's platform, users grant SymbolStory a perpetual, irrevocable, non-exclusive, royalty-free license to use, analyze, and process any data provided by the user ("User Data") for the purpose of improving and training its AI-based engine, developing new features, and other internal uses. This does not include personal images uploaded by users, which remain the sole property of the users. SymbolStory will not use these personal images for any internal or external purposes beyond the scope of the user's own projects on the platform.

To use the service and open a user account, you must be over the age of eighteen (18) years or older (see section 17 below). However, you (as a parent or legal guardian) are allowed to use your account (as defined below) for different recipients other than yourself, and those recipients may be under the age of eighteen (18) years ("Authorized Minors"), by adding and registering them under your account. You may add and register an Authorized Minor under your account only if you are the parent or legal guardian of that Authorized Minor. In addition, your treating clinician may, subject to your authorization, add Authorized Minors to your account if you are their parent or legal guardian. By agreeing to these terms of use (and if you are a parent, on behalf of the recipient), you confirm and declare to SymbolStory that you have the legal authority to do so, and in the case that you are a parent, in accordance with sections 4 and 17 of these terms of use and SymbolStory's privacy policy, to receive the medical information of that recipient and provide information about him as stated.

Parents, recipients, and clinicians, all of you under these terms of use are users of SymbolStory services (the "Users"), and the terms will apply to each user accordingly. Users have the option to register through the website for our mailing list to receive updates about developments in services, special offers, discounts, etc.

Important – Absence of Medical Consultation by SymbolStory:

SymbolStory does not provide medical advisory services or any clinical services. SymbolStory bears no responsibility for the information provided or transmitted through the service, as well as for the content on the website.

All clinical and therapeutic content and information conveyed through the services are created and/or approved by the users ("Therapeutic Information"). Therefore, SymbolStory is not, and will not be, responsible in any way for any Therapeutic Information, including any diagnosis, exercise, practice, or recommendation, including any treatment recommendations, conveyed through the use of SymbolStory services by any user, including clinicians.

When you use the service, you agree that SymbolStory is not responsible, and will not be liable, for any claim, loss, or damage arising from the service or its use by you or by any other user. SymbolStory does not endorse any decision made or action taken, or not taken, in whole or in part, relying on the service or any information conveyed through the service, or received from the service, and disclaims any responsibility for them.

SymbolStory does not examine, approve, or in any way endorse any clinician or parent/caregiver, and the choice of a parent/caregiver to receive therapeutic services from a treating clinician, and the choice of a treating clinician to provide services to a parent/caregiver, is the sole responsibility of the parent/caregiver or treating clinician (as the case may be).

You confirm and agree that the use of SymbolStory services is entirely at your own risk.

3. Registration and User Account

To use the services, you must register and create a user account through the online interface (the "Account"). To complete the registration, you need to provide various details such as name, phone number, email address, gender, license number (for clinicians), and other demographic information. During the registration process, you will be asked to choose a password and a username for your account. You are solely and fully responsible for maintaining the confidentiality of your login details (email, username, and password) for your account and all activities occurring under your account. You agree not to disclose your login details to any third party. In case you forget your password, you can request a new one through the appropriate service, and it will be sent to your registered email address. Your account is at risk if you allow someone else to use it recklessly, and we reserve the right to terminate your account if we decide that you or anyone else using your account violates these terms.

You must provide accurate and complete information when creating an account, and you agree not to falsely represent any personal information provided for the purpose of registering the account or account details, and to keep your account details accurate and up-to-date.

You are not allowed to assign or transfer your rights or delegate your obligations under the account and/or these terms without the prior written consent of SymbolStory. You must promptly inform us of any unauthorized use of your account or login details or any other security breach. We cannot and will not be liable for any loss or damage arising from your failure to comply with the terms or any unauthorized use of your account or any other security breach. You may incur losses for SymbolStory and/or others due to any such use.

If you want to change your account details or cancel your registration, you may do so by contacting SymbolStory support. Subject to fulfilling all your commitments to SymbolStory until the cancellation date (and also thereafter in connection with commitments that are intended to continue after the termination of the relationship between the parties under these terms), and in accordance with SymbolStory's cancellation policy described in Section 8 below, your account will be terminated within a reasonable time after your request, and from that date, you will no longer be able to access your account, and without prejudice to any right or claim standing for SymbolStory, all the rights and licenses granted to you under these terms will be terminated and immediately revoked.

Please note: The termination of your account may result in the loss and/or unavailability of content, features, or capabilities related to your account. SymbolStory will not be liable in any way for such unavailability and/or loss as mentioned.

4. Statements and Commitments of the Patient/Parent

Your use of the service (or any part thereof) is contingent upon the fact that you declare and commit as follows:

You have the legal authority to enter into these terms and create a binding agreement under any applicable law, to use the service in accordance with these terms, and to fulfill your commitments under these terms, all on your own behalf and/or on behalf of any patients you added and specified under your account, or on their behalf.
You have the knowledge and judgment necessary to decide whether to use the service or to rely on any other available information within its framework.
You will seek advice from authorized and professional third-party entities in the field of treatment (including medical advice) in order to protect your interests and your health before relying on any treatment information provided through the services. You confirm that there is no professional relationship (including any relationship between a therapist and a patient or between a consultant and an advisee) between you and SymbolStory, and you are not allowed, in principle, to rely solely on, or in any way, on any information or content, or any features that you find within the service or through it.
If you connect to the service, access it, or use it on behalf of a third party, a family member, or any dependent, you declare and commit that you are legally authorized to represent that third party, family member, or dependent under these terms and to obligate him by these terms. You hereby make all statements and commitments in these terms on behalf of yourself and of that third party, family member, or dependent.
You have all the necessary consents required by any applicable laws for the uploading, processing, sending, and displaying of any personal and medical information of others that you operate in connection with SymbolStory services, and you will strictly comply with all laws regarding such information.
Your agreement to these terms does not waive, and will not violate, any other agreement you are committed to, any law, regulation, order, or court decision to which you are subject.
You have all the necessary consents required by any applicable laws for the uploading, processing, sending, and displaying of any personal and medical information of others that you operate in connection with SymbolStory services, and you will strictly comply with all laws regarding such information.
Your consent to these terms does not waive, and will not violate, any other agreement you are committed to, any law, regulation, order, or court decision to which you are subject.
You confirm that you are solely responsible for compliance with the requirements of applicable laws regarding your use of the service.

5. Prohibited Behaviors

Certain behaviors are strictly prohibited within the framework of our services. Please carefully read the restrictions. Failure to comply with the provisions of these terms may lead (at the sole discretion of SymbolStory) to the suspension of your access to the services and may expose you to civil and/or criminal liability.

You are not allowed, whether by yourself or on behalf of others:

(i) To copy, modify, adapt, translate, reverse engineer, decompile, or disassemble any part of the services or any information and resources about the services, SymbolStory's systems, and its technology, or any other content related to them (including contact information, social stories, audio recordings, text, symbols (logo), icons, buttons, images, data sets, links, other dedicated content, documents, data, related graphics, intellectual property, and other properties together, the "Content"), in any way or to display, perform, or distribute them publicly;

(ii) To use the services and/or the content on any other site or network environment other than the site, for any purpose, or to duplicate or copy the content without the express written consent of SymbolStory in advance;

(iii) To create a browser or border environment around the services, their content, or any part of them (without frames or inline linking);

(iv) To interfere with the privacy or rights of any other user or violate them, or to collect or harvest personally identifiable information about visitors or users of the service without their explicit and informed consent, including using any robot, spider, site search application, or manual or automated process to retrieve, index, or data mining;

(v) To defame, slander, harass, intimidate, threaten, or otherwise violate the legal rights of others;

(vi) To transmit or make available in any way any virus, worm, Trojan horse, time bomb, network bug, malware, or any other computer code, file, or program that is harmful, invasive or intended to take over, or any other code or component that is harmful, disruptive, or invasive in fact or in force;

(vii) To interfere with the operation of our services, or the servers or networks hosting our services, or to sabotage it, or to refuse to comply with the requirements, rules, policies, or regulations of those servers or networks;

(viii) To sell any use of our services or access to them, grant a license for such use or access, or exploit them for any commercial purposes whatsoever;

(ix) To perform any circumvention or reflection of any part of this site without the explicit written permission of SymbolStory in advance;

(x) To interfere with the operation of their services, or the servers or networks hosting their services, or to sabotage it, or to refuse to comply with the requirements, rules, policies, or regulations of those servers or networks;

(xi) To create a database using systematic downloading and storage of any content of their services or any part thereof;

(xii) To transfer any data generated from their services without the explicit consent of SymbolStory in writing in advance; or (xiii) to transfer and/or assign the user's account password, even temporarily, to any third party;

(xiv) To use our services for any purpose that is not legal, moral, or authorized;

(xv) To use the services, for the purpose of uploading any information that is not reasonably required for the viewing of medical information, collection, measurement, processing, presentation, diagnosis, and analysis, without limitation;

(xvi) To capture, upload, display, transfer, and/or otherwise provide SymbolStory or users with any information, images, or other content that is (1) a property of a third party not treated under your account, or (2) treated by you as a clinician to provide health services under your role, or that is, among other things, harassing, offensive, inappropriate, illegal, pornographic, unauthorized, or vulgar; or (xvii) to use our services and/or content for purposes that are not personal or commercial without the explicit written consent of SymbolStory in advance or in accordance with a written agreement

6. Lack of responsibility of therapists

You confirm and agree that SymbolStory shall not be liable or responsible in any way for any damage, loss, liability, cost, expense, or claim related to any advice or information provided by clinicians as mentioned, including, without limitation, regarding their reliability, quality, accuracy, or usefulness of such advice or information, as well as in connection with the clinician's identity, qualifications, authorization, or actions and omissions.

7. Commitments and Statements of Therapists

If you are a clinician, you hereby commit and declare to SymbolStory that: (i) you are a licensed professional in the healthcare field and your license has not been revoked or canceled; (ii) you will make your best efforts and use professional standards reasonably accepted in your field when using the services, during treatment, or providing any services to the patient, including uploading patient information to the SymbolStory platform; (iii) you have the complete authority and authorization to agree to these terms; (iv) you have the authority and full permission to keep all information that comes to your knowledge from SymbolStory services confidential, and you will not use the information for any purpose other than necessary for providing your treatment services; (v) you will not accept any payment, benefit, or bribe in violation of any laws, regulations, rules, and ethical standards applicable to you, or any of them ("Laws"); (vi) you acknowledge that any patient with whom you come into contact, or whose medical information you access through SymbolStory services, is considered your patient in accordance with all applicable Laws, and you will strictly adhere to the requirements of these Laws in providing healthcare services; and (vii) you will defend and maintain the confidentiality of any patient information you receive or have access to in the course of providing services, and you will use or disclose it (only to third parties bound by appropriate non-disclosure commitments) as necessary for the provision of treatment services to the relevant patient.

8. Payment and Cancellation

In exchange for receiving the services, users will pay SymbolStory using the payment methods specified during the service registration. The payment method documented in our records must be valid and accepted to purchase paid services or participate in free trial periods or other free promotions related to paid services. You agree to pay for any paid service you order from SymbolStory. SymbolStory will charge the payment method documented in its records on the first day of each billing period for the relevant subscription, and if the documented payment method becomes invalid due to the expiration of a credit card or a similar reason, and we cannot charge you for the next billing period, you may lose access to the relevant paid service until you update your payment method. If possible, we will send you a notification when such a situation occurs. If you do not update your payment method within a reasonable timeframe, SymbolStory may cancel your subscription.

Cancellation Policy: You can cancel your registration within 14 days from the confirmation date without providing a reason. The cancellation period will expire 14 days after the date of your registration for the services. To exercise your right to cancel, you must inform our support service at contact@SymbolStory.app of your decision to cancel your agreement through an unequivocal statement. If you purchased a subscription to SymbolStory services for a renewing period automatically, you may choose to stop automatic renewal or cancel the subscription at any time before the current subscription period ends. In the event that you notify us of your intention to cancel the subscription, the cancellation will take effect from the subscription period and the next charge onward.

9. Privacy Policy

SymbolStory respects your privacy and is committed to protecting the information you share with us. We believe you have the right to know our practices regarding the information SymbolStory collects when you connect to our services, access them, or use them. Our policies and practices, as well as the type of information collected, are described in our Privacy Policy. If you intend to connect to our services, access them, or use them, before doing so, you should read our Privacy Policy and agree to it.

10. Intellectual Property Rights

The company grants you a limited, personal, non-exclusive, non-transferable, and non-sublicensable license, revocable at any time, to use: (a) the application on your smart device or on a smart device under your control; (b) the SymbolStory website and platform, all subject to the terms and conditions of this agreement. These terms do not entitle you to any right on the SymbolStory platform and/or website, except for a limited right to use it in accordance with these terms of use.

SymbolStory's trademarks and its symbol (whether registered or not), as well as any other intellectual property symbols that SymbolStory uses in connection with the service ("SymbolStory Trademarks"), are all trademarks and/or trade names of the company, whether registered or not. Any and all SymbolStory Trademarks are the property of SymbolStory and/or licensed to it under copyright and other intellectual property rights under Israeli law, foreign laws, and international conventions. You are not granted any right, license, or affiliation with SymbolStory's trademarks, and you agree not to claim any right, license, or affiliation in relation to SymbolStory Trademarks, and therefore refrain from using any such marks unless expressly authorized for such use.

Our services, content, and all related intellectual property rights, including, but not limited to, inventions, patents and patent applications, trademarks, trade names, symbols, copyrighted materials, graphics, text, images, models (including the "look and feel" of our services), specifications, methods, rules, information, knowledge, algorithms, technical data, interactive features, source code, and object code, files, interface, and trade secrets (together, "Intellectual Property"), are owned by SymbolStory and/or licensed to it under copyright and other intellectual property rights under Israeli law, foreign laws, and international conventions. You are not allowed to copy any material subject to SymbolStory's intellectual property rights, including SymbolStory's intellectual property, distribute it, display it, publicly perform it, make it publicly available, reduce it in a form readable by humans, decode it, break it, process it in a manner allowing the extraction of derivative licenses, use it for commercial purposes, sell it, rent it, lend it, process it, display it, reverse engineer it, integrate it with other software, translate it, modify it, or create a derivative work of it, either by yourself or on behalf of others, in any way or by any means, unless explicitly permitted in the terms.

You are hereby prohibited from removing or deleting any notices of copyrights, restrictions, and trademarks indicating the intellectual property rights of SymbolStory or its licensor, or any part of such notices, including [®], copyright sign [©], or trademark sign [TM] included in the content on the website or accompanying such content. You declare and undertake that you will comply with all applicable laws in this regard.

11. Availability

The availability and functionality of our services depend on various factors, such as communication networks. SymbolStory does not commit or guarantee that our services will operate and/or be available at all times without disruption or interference, or that they will be free from errors. SymbolStory shall not be responsible for any losses or damages caused by any entity or individual for any reason beyond the reasonable control of SymbolStory, including, but not limited to, force majeure, acts or omissions of civil or military authorities of a state or nation, fire, strike, flood, riot, terrorism, war, disruption of public services, or otherwise.

12. Changes to Our Services

SymbolStory reserves the right to modify our services (or any part of them, including, but not limited to, the content), amend them, enhance them, improve them, make any other changes, or terminate them, temporarily or permanently, without notice, at any time at its sole discretion. Additionally, you hereby acknowledge that the content provided as part of our services may be altered, expanded in terms of content and form, or removed at any time without prior notice. You agree that SymbolStory shall not be liable to you or any third party for any modification, suspension, or termination of our services or the content included in our services.

13. Disclaimer and Liability

SymbolStory does not commit or make any statements regarding the use of the content available on our services, the inability to use it, or operate it, or the results of its use. You agree and acknowledge that the use of our services is entirely at your own risk.

You assume full responsibility for any use of services that does not comply with these terms, SymbolStory's instructions, or recommendations.

SymbolStory shall not be responsible for any damages, including, but not limited to, direct, indirect, special, incidental, or consequential damages of any kind, whether arising from the use of the services or in connection with it, or any information resulting from the use of the service, whether or not the company has informed the user of the possible damage.

Our services are provided on an "as-is" basis, without any warranty of any kind, whether express or implied, including, but not limited to, express warranties of title or non-infringement or implied warranties of merchantability or fitness for a particular purpose or specific functionality. SymbolStory refuses to take any responsibility and does not provide any statements or warranties regarding the accuracy, quality, availability, reliability, suitability, completeness, truth, usefulness, or efficiency of any content available on our services, including any medical information. The use of our services is entirely at your own risk, and SymbolStory shall have no responsibility for such use. SymbolStory refuses to take responsibility for any medical information uploaded or provided by users through the services.

SymbolStory does not warrant that the operation of our services will be accurate, complete, unrestricted, error-free, or free from viruses, worms, other harmful components, or other software limitations.

14. Limitation of Liability

SymbolStory, including its employees, directors, shareholders, contractors, and agents, shall not be liable for any damages, including, but not limited to, direct, indirect, special, incidental, or consequential damages of any kind, whether in contract, tort, or any other legal theory, arising from our services or resulting from them, or the use or inability to use our services, content, loss of goodwill or profits, performance or non-performance by SymbolStory under these terms, any other act or omission of SymbolStory for any other reason; or based on a breach of liability, breach of contract, negligence, strict liability, or any other legal theory, whether SymbolStory has been advised of the possibility of such damages or not.

You may not file any claim for any breach of these terms more than one (1) year after the cause of action arises. Since some countries do not allow the limitation or exclusion of incidental or consequential damages, these limitations may not apply to a user residing in those countries.

These limitations, exemptions, and disclaimers shall apply to all claims for compensation, whether based on contract action, warranty, strict liability, negligence, tortious act, or otherwise. You acknowledge and agree that these liability limitations are fair allocations of risk that constitute a substantial part of the consideration for SymbolStory's services to you, even if SymbolStory has been warned of the possibility of such hidden and/or consequential damages. The above-mentioned limitation of liability shall apply to the fullest extent permitted by law in the relevant jurisdiction, and SymbolStory's cumulative liability to you shall not exceed any amounts paid to SymbolStory for your use of the service. If you have not paid any fees to SymbolStory for the use of the service or if no fees have been paid on your behalf, then SymbolStory shall have no liability towards you.

15. Indemnification

You agree to defend, protect, and release SymbolStory and its shareholders, owners, directors, officers, employees, accordingly, from and against all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including, but not limited to, attorneys' fees) arising directly or indirectly from the following: (i) any breach of any of these terms by you or on your behalf; (ii) any type of damage, whether direct, indirect, special, or consequential, that you may cause to any third party related to your use of our services (including the violation of any third party rights by you); (iii) any decision made or not made, or any action taken or not taken based on processed information; and (iv) any violation of any law or regulation by you.

16. Corrections to Terms

SymbolStory reserves the right to modify the terms from time to time at its sole discretion and without prior notice. We will provide notice regarding material changes to these terms on the homepage of the website and/or within the application, and/or we may send you an email notification about such changes to the email address provided during registration. Material changes as mentioned will take effect seven (7) days after the notice is provided on our website or sent via email. Otherwise, all other changes to these terms are effective as of the "Last Update" date stated, and your continued use of our services after the last-written date constitutes acceptance of those changes and agreement to be bound by them.

17. Termination of Services

At any time, SymbolStory reserves the right to block your access to our services and/or temporarily or permanently restrict your access to our services, at its sole discretion, in addition to any other legal remedies available to SymbolStory under any applicable law. SymbolStory may take such actions if it decides that there is any violation of any of these terms in any way.

Furthermore, SymbolStory reserves the right at any time, at its sole discretion, to terminate the operation of its services or any part thereof, temporarily or permanently, without prior notice. You agree and acknowledge that SymbolStory assumes no responsibility for the termination of its services and any loss of data associated with it.

The provisions of Section 4 (User Statements and Commitments), Section 5 (Usage Limitations), Section 6 (Clinicians' Lack of Liability), Section 7 (Clinicians' Commitments), Section 9 (Privacy Policy, including the privacy policy mentioned in the same section), Section 10 (Intellectual Property Rights), Section 11 (Availability), Section 13 (Disclaimer and Liability), Section 14 (Limitation of Liability), Section 15 (Indemnification), Section 17 (Termination of Service), Section 18 (Minors), and Section 20 (General) shall survive the termination or expiration of these terms.

18. Minors

To open an account on our services, you must be above the age of eighteen (18). We reserve the right to request proof of age at any stage so that we can verify that minors under the age of eighteen (18) are not using our services. If the patient is under the age of eighteen (18), a parent or legal guardian may use the service, add and register the patient under their account, and provide medical information on behalf of their child. The parent or legal guardian assumes full responsibility for ensuring that the information they provide to SymbolStory about their child is securely maintained and accurate.

For clinicians: If the patient is under the age of eighteen (18), you hereby declare that you have all the necessary consents, approvals, and rights to provide health services to the patient, including receiving medical information, accessing it, processing it, sending it, displaying it, and delivering it on behalf of the minor, as applicable, and all in accordance with our privacy policy.

If you add and register a patient under the age of 18, you hereby declare to SymbolStory that you are the parent and/or legal guardian of that patient or that you are a clinician who has obtained all required consents, including from the patient's parents or legal guardian, to open and use SymbolStory's services on behalf of the patient, and you are entitled under the law to do so.

In the event that we become aware that a person under the age of eighteen (18) is using our services in violation of the above terms, we will prohibit and block that user from accessing our services and make all efforts to immediately delete any personal information related to that user.

Notwithstanding anything in these terms, please note that our website is not intended for and is not designed to attract children under the age of 13.

19. Platform Providers

As long as SymbolStory allows the download of the application from mobile app markets (such as the App Store), service providers or distributors who are third parties ("App Providers"), your use of the application may also be subject to the terms of use of the App Providers regarding your use of the application ("App Providers' Terms of Use"). 20. Uploading Professional Content to the SymbolStory System

From time to time, the SymbolStory system and/or entities on its behalf may enable healthcare professionals using the SymbolStory system to upload professional content ("Uploaded Content") to the SymbolStory system, either through the system interface or by other means facilitated by SymbolStory. You hereby confirm that any Uploaded Content you upload to the SymbolStory system is your original creation or that you have all the necessary permissions, approvals, and rights to upload the Uploaded Content to the SymbolStory system and grant the following usage rights. SymbolStory will not assume any responsibility for verifying the Uploaded Content, and will not assume any responsibility for its quality or any third-party claims related to the Uploaded Content. The healthcare professional uploading the Uploaded Content agrees to bear all such responsibilities. You hereby grant SymbolStory an unlimited, irrevocable, cost-free, and non-exclusive license to use, edit, modify, and distribute the Uploaded Content you have uploaded. SymbolStory is authorized but not obligated to provide any indication regarding the identity of the contributor of the Uploaded Content.

21. General

· Any heading or section title included in these terms of use is provided for convenience only and does not in any way define or explain any section or provision in these terms of use.

These terms of use do not create, and shall not be construed as creating, any agency, partnership, joint venture, employee-employer relationship, or franchisor-franchisee relationship between SymbolStory and you.

These terms, and the legal rights and remedies granted under them, as well as any claims, disputes, or controversies arising out of or related to them and/or the service, its interpretation, breach, termination, or validity, will be governed in all respects solely by the laws of the State of Israel, without regard to its conflict of laws principles. Such matters will be settled exclusively, and you hereby agree to submit to the exclusive jurisdiction of the courts in Tel Aviv, Israel.

SymbolStory reserves the right to assign its rights and obligations under this agreement and/or transfer ownership and intellectual property rights in the service to a third party without your explicit and written consent or prior notice. Your rights and obligations under these terms are not subject to transfer. Any attempt to assign or transfer them without SymbolStory's explicit and written consent in advance will be null and void.

If any provision of these terms is found to be illegal, void, or unenforceable for any reason, that provision will be deemed to be severable from these terms and will not affect the validity and enforceability of the remaining provisions.

No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.

These terms constitute the entire agreement and understanding between you and SymbolStory regarding the subject matter herein and supersede any prior or contemporaneous agreements, understandings, representations, warranties, commitments, or statements, whether in writing or orally, between SymbolStory and you concerning the service. You agree that you will not assert any claim at any time or place that these terms have been orally altered or amended or otherwise modified by any representation, act, or omission by SymbolStory.

SymbolStory will make an effort to respond within a reasonable timeframe. By contacting the company, you acknowledge and agree that you are doing so voluntarily and that you are not disclosing any intellectual property rights of any third party. Without limiting the foregoing, all rights, including intellectual property, arising from the message will be owned by SymbolStory and will be considered as the confidential material of SymbolStory.

Do not share any medical information when sending a message to the support and customer service teams of SymbolStory. Medical information should be shared with healthcare professionals, and the support and customer service teams are not healthcare professionals and cannot provide clinical advice.
